Dibs Pack — Terms of Service

Welcome to Dibs Pack. These Terms of Service ("Terms") govern your access to and use of the Dibs Pack website at dibspack.com (the "Site") and any purchase you make from us. By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site. In these Terms, "Dibs Pack," "we," "us," and "our" refer to the operator of the Dibs Pack store; "you" refers to the customer or site visitor.
1. About Dibs Pack and consignment
Dibs Pack sells authentic collectibles — including trading cards, sealed products, figures, die-cast models, and related hobby supplies. Some items are owned by Dibs Pack, and some are offered on a consignment basis on behalf of third-party sellers ("consignors") who rent display space ("cabinets") from us. Regardless of ownership, Dibs Pack handles the listing, sale, payment, and fulfillment, and remains your point of contact for every order.
2. Eligibility
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to purchase from the Site.
3. Products, condition, and grading
We describe and photograph each item as accurately as we reasonably can. Because many items are pre-owned or single collectibles, minor wear consistent with age and handling may be present and is considered part of the item's condition. Any condition descriptions or grades that are not from an independent third-party grading company (for example PSA, BGS, or CGC) represent our own good-faith opinion and are not a guarantee. Colors may vary slightly due to photography and screen settings. "Raw" (ungraded) cards are sold as-is based on the photos and description provided.
4. Authenticity and trademarks
We take reasonable steps to verify the authenticity of the items we sell. If you believe an item is not authentic, contact us promptly (see Section 14) so we can investigate. Dibs Pack is an independent reseller. We are not affiliated with, authorized, endorsed, or sponsored by any manufacturer or brand owner, including but not limited to Panini, The Pokémon Company, Nintendo, Mattel, Hot Wheels, Hasbro, and Bandai. All product names, logos, and brands are the property of their respective owners and are used for identification purposes only.
5. Pricing and currency
All prices are listed in Philippine Peso (PHP) and are inclusive of taxes where applicable. We make every effort to display accurate pricing, but errors may occur. If we discover a pricing error on an item you have ordered, we may cancel the order and refund any amount paid. Some collectibles are offered on a "price on request" basis and are sold by negotiation; message us to make an offer or ask for the current price.
6. Orders and acceptance
Your order is an offer to purchase. We reserve the right to accept or decline any order, or to limit quantities, for any lawful reason — including suspected fraud, pricing errors, or stock that is no longer available (for example, a one-of-a-kind item that sold moments earlier). If we cancel an order you have already paid for, we will refund it in full.
7. Payment
We accept the payment methods shown at checkout, which may include online card payment (via our third-party payment processor) and manual bank transfer / InstaPay QR ("Bank Deposit"). For manual Bank Deposit orders, your item is reserved and your order is held as pending for one (1) hour. Please complete payment within that window and send your proof of payment together with your order number to us through the Dibs Pack Messenger page. If payment is not received within the window, we may cancel the order and return the item to stock so that others can purchase it. We do not store your full card details; online card payments are processed by our payment provider under their own terms.
8. Availability of single items
Many of our collectibles are one-of-a-kind. Placing an order reserves the item; once reserved or sold, it is removed from the store. If two orders are received for the same unique item, the first completed order takes priority, and any later order will be cancelled and refunded.
9. Shipping and delivery
We offer nationwide shipping with tracking and, where available, free in-store pickup at our counter. Delivery timeframes are estimates and are not guaranteed. Once an order is handed to the courier, delivery timing is subject to the courier's service. Risk of loss passes to you upon delivery to your address or upon pickup. We pack items securely (sleeved, toploaded, and protected) for transit. Please provide a complete and accurate delivery address; we are not responsible for delays or losses caused by incorrect address details.
10. Returns, refunds, and cancellations
Due to the nature of collectibles, all sales of individual and graded collectible cards and of sealed or opened products are final, except where an item arrives damaged in transit, is materially not as described, or is the wrong item. Unopened accessories and supplies may be returned within 7 days of receipt if unused and in original packaging; return shipping is for the buyer's account unless the return is due to our error. To start a claim, contact us within 48 hours of delivery with your order number and clear photos.
11. Intellectual property
All content on the Site created by Dibs Pack — including text, layout, graphics, and our logo — is owned by or licensed to us and may not be copied or reused without permission. Product images of branded items remain the property of their respective owners.
12. Acceptable use
You agree not to use the Site unlawfully, to interfere with its operation or security, to scrape or harvest data, or to place fraudulent or speculative orders.
13. Disclaimers and limitation of liability
The Site and its content are provided "as is" and "as available" without warranties of any kind except those that cannot be excluded under applicable law, including the Consumer Act of the Philippines (Republic Act No. 7394). To the fullest extent permitted by law, Dibs Pack's total liability for any claim relating to an order is limited to the amount you paid for the item(s) concerned, and we are not liable for indirect or consequential losses. Nothing in these Terms limits your statutory rights as a consumer.

15. Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be subject to the exclusive jurisdiction of the proper courts of the Philippines, without prejudice to your rights under consumer-protection laws.
16. Changes to these Terms
We may update these Terms from time to time. The version posted on the Site at the time of your purchase applies to that purchase. Continued use of the Site after changes means you accept the updated Terms.
